You or Yours means the person ordering Goods from World of Blinds & Interiors Ltd. 


We or Us means World of Blinds & Interiors Ltd, 60 Seafield Road, Inverness, IV11SG. 


Order means an instruction to proceed with the manufacture of a made product or supply of any product. 


Reasonable Charge relates to any cost incurred by Us in the manufacture or supply of any products or service, excluding any deposits paid. 

Our Terms and Conditions of Supply and Fitting Goods are ruled by the requirements of the Consumer Rights Act (CRA) 2015. The Child Safety Requirements BS EN 13120:2009+A1:2014 and The Alternate Dispute Resolution for Consumer Disputes Regulations 2015. 

World of Blinds & Interiors Ltd invites you to buy goods from us. A legally binding contract with you will only arise once World of Blinds & Interiors Ltd has received a deposit OR signature to commence with your order. We will send you an email confirming the accepted order and can provide a printed order confirmation via post on request, should you not have an active email account. Should you fail to receive your order confirmation email, please inform us as soon as possible so we can rectify.

The Price of any goods ordered by You will be the price shown on the Order Confirmation of your Contract. Your order will include VAT at the current rate. Our VAT registration Number is 167638274. 



2.2 Payment of the balance of the purchase price for goods is due at the time of installation, or beforehand, which will be arranged by Us.

The cost of delivery and installation (where applicable) are included in the service. If you have asked to collect the goods from our premises, you can do so during our opening hours, when we notify you that the Goods are ready. 


Fittings, deliveries and collections are normally made between 9am and 5pm, we would expect arrangements to be made to help us meet these times. The price of the installation was agreed on the assumptions that; there is going to be no more than 2 site visits (survey and installation), there will be unobstructed access outside your property for vehicle parking, the area where the Goods are to be fitted are unobstructed, surfaces and grounds the Goods are to be fixed to are in good condition allowing us to easily obtain good fixings and with no objects in the immediate working area, there is no Asbestos that we would likely to be in contact with, and that no items under warranties/guarantees will be invalidated by the installation. We may make a further, reasonable charge for the additional time, costs or materials if these conditions are not met. We are not responsible for any loss or damage to your property that is not foreseeable, unless due to our negligence, or for the cost of repairing any pre-existing faults to your property, or for any damage discovered whilst undertaking the installation. We will not be responsible for carrying out any building work, moving any furniture, clearing access or invalidation of any warranties should you not tell us in writing before you place your order. 


The Goods you receive from us must be; of satisfactory quality, fit for common purpose, or any purpose made known to us, and must meet any description given. Please note that any images of any products we supply, in our sales literature or online, are for illustration purposes only, and we cannot guarantee that these printed/computer displayed images will reflect the colour of the goods accurately. Our packaging may also vary. 


ACCESS


If we have agreed to install the Goods for you and you do not agree to allow us access to the premises without having a good reason for this, we may charge you additional, reasonable costs, incurred to us as a result. If despite our reasonable efforts we are unable to contact you or to re-arrange access to the premises, we may end the contract and you will be liable to pay us a sum up to the price due under the contract.


3.2 Due to the nature of our business, and the size of the demographic we service, we cannot arrange for a specific hour or date of delivery, but any requests will be given full consideration, but we cannot be held responsible for any factors, out with our control, for any possible delays.


3.3 Goods will remain the property of World of Blinds & Interiors Ltd until paid for in full.


3.4 *Although delivery dates may be postponed by you, payment for the goods ordered will become due and payable within 7 working days of the goods being ready, this is an express condition of sale.



3.5 If for any reason, any goods within an order have been miss-measured/damaged and replacements or re-makes are required, then the balance would be due on works completed from your order. The miss-measured/damaged goods will be deducted from the balance and payable once rectified.

If we agree to any service for you, we will ensure that this is carried out using reasonable care and skill, to the best of our abilities and control.

We reserve the right to cancel any order if:



5.1 We have insufficient stock to make and deliver the goods ordered due to suppliers' stock levels, faulty batches or deliveries to us, being lost or damaged in transit. 


5.2 The Goods ordered, unknown to us have suddenly been discontinued. 


5.3 A pricing error or typing error has occurred. 


5.4 If for some reason we are unable to complete your order and require to cancel your order, then we undertake to refund all sums paid as quickly as possible. We regret we cannot be liable for any consequential losses suffered. 


5.B CANCELLATION BY YOU


You may cancel a contract if we have told you about a pricing error/error with a description of the goods and you do not wish to proceed, if there is a risk that supply may be significantly delayed, or if you have legal right to end the contract because of something we have done wrong.


5.B.1 If we miss the delivery deadline for any of the Goods, you can treat the contract as at and end, if; we have refused to deliver the Goods, delivery time was essential, and you have informed us of this at the time of your order, and we accepted the order on that basis. Alternatively, you can give us a new deadline for re-delivery, that must be reasonable and if this is not met, then treat the contract as at an end. You can then cancel your order for any of the Goods or reject any of the Goods that have been delivered already under the contract.


We will then refund the money you have paid for the cancelled Goods, and their delivery and installation. Goods already delivered to you must be returned to us at our expense or you must allow us to collect them at our expense.

Our staff are expected to act respectfully, courteously and well-mannered when at work and in your home. We expect the same respect and courtesy in return. Rudeness or any unpleasantries will not be tolerated and may result in the immediate termination of your contract and any reasonable costs for works completed will not be refunded.

IF Goods or fabric you order, become unavailable, we will notify you as soon as possible to suggest a suitable alternative, or to allow you an opportunity to cancel Your order. We may not have any control over timescales on this matter due to suppliers informing us on certain products.

We will not be liable to You by way of representation (unless fraudulent) common law duty or under express of implied term on contract for:


8.1 Any losses which are foreseeable by both parties when the contract is formed arising in connection with the supply of Goods or their uses by you. 


8.2 Any losses which are not caused by any breach by us. 


8.3 Business or Trade losses (including, without limitation loss of products, loss of goodwill, loss of business and loss of reputation); Or


8.4 Any failure by You to give us correct measurements for the Goods. 


8.5 Our entire liability in connection with the contract will not exceed the purchase price of the Goods in question. 


8.6 Nothing in this contract excludes or limits liability for;


8.6.1 Death or personal injury from our negligence or that of our employees or sub-contractors. 


8.6.2 Liability to damage of property or injury to persons under the consumer protection act 1987. 


8.6.3 Fraud or


8.6.4 any other matter that we cannot by law exclude or restrict. 


8.7 The provisions under the contract (Rights to Third Parties) Act 1999 are expressly excluded from the contract so that no third party may claim any rights under the contract. 


8.8 We do not accept any liability for any breakages or damage of items within your home/place of work/place of business that have not been moved by you, prior to installation. 



8.9 We will not be liable for any failure or delay in performing our obligations in the contract to the extent that such failure or delay caused by a Force Majeure event. A force Majeure event means any event beyond our reasonable control, which by its nature could not have been foreseen, or, if it could have been foreseen, was unavoidable, including strikes, lock-outs or other industrial disputes (whether involving its own workforce, or a third party’s), failure of energy sources or transport network, acts of god, war, terrorism, riots, civil commotion, interference by civil or military authorities, national or international calamity, armed conflict, malicious damage, breakdown of plant or machinery, nuclear, chemical or biological contamination, sonic boom, explosions, collapse of building structures, fires, floods, storms, earthquakes, loss at sea, epidemics or similar events, natural disasters, or extreme adverse weather conditions, or default or suppliers or subcontractors.

World of Blinds & Interiors Ltd offer a 12 month guarantee on all products and any defects or problems with any of our products in the way of flawed or damaged materials, or failure in any way to prevent the product to work in the correct way, World of Blinds & Interiors Ltd will repair or replace any goods to this nature under the 12 month guarantee promise with the exception of products fitted in an unsuitable environment for the material supplied or products installed correctly by the customer. This for example would apply to any product other than a waterproof blind or shutter being fitted in a damp or moist area that could affect the material or working of the product as it is not a suitable choice for the area or purpose. 


All Blinds will only be made to the exact specifications of the original order with no size, colour or product change permitted, no discount or refund will be given and any remakes are only to the original order specification. All customers, when in receipt of their order, have 5 days to report any damaged or defective goods due to manufacturing or damage caused in the delivery process. 

We make Products in good faith according to the sizes supplied and You, the customer has to take full responsibility for the accuracy of the sizes, this includes transposing Imperial to Metric. Although we generally take full payment up front for supply only, if for any reason we do not, in good faith, then payment for Goods supplied cannot be withheld if sizes or details supplied are incorrect in any way. Due to the nature of our products being made to measure for Your order, the World of Blinds & Interiors Ltd reserves the right to make minor adjustments or corrections at the time of completion, so as to fully meet your requirements. Any costs involved in this will be at Your own expense and any will be expected to be paid in full, before any adjustments or corrections are made.

Our products are compliant with the Child Safety Requirements of BS EN 13120. There are range of safety devices which have been tested to the new mandatory standards and can also make existing blinds safer. There are options for virtually every style of blind, so you do not have to wait until you change your blind to make it safer. 


GENERAL SAFETY ADVICE. If installing blinds yourself, make sure that you follow any fitting instructions carefully and make sure any safety devices supplied are correctly installed. We do not take any responsibility for blinds that have not been installed by World of Blinds & Interior Ltd. 


Do not place your child's cot, bed, high-chair or playpen near to a window blind. Make sure all cords and chains are always secured out of reach of babies, young children, or vulnerable persons. Do not tie cords or chains together. Make sure cords or chains do not twist and create a loop. Do not put furniture near to a window blind as children love to climb. 


Your quotation includes blinds that require the supply and installation of a safety device(s) to ensure compliance to the General Product Regulations. By law, we must install these devices. If you change your mind, we have options which are safe by design, meaning they contain no, or concealed/tensioned, cords or chains. 



For a Commercial/Public Building where the product requires a non-integral device. Your quotation includes blinds/blinds that requires the installation of additional safety devices to make the compliant with the Child Safety requirements of BS EN 13120. If the blinds are to be used in premises where children aged between 0-42 months are likely to have access or be present, we are legally obliged to install these devices. We can provide inherently child safe window blinds with no or concealed/tensioned operating cords or chains – please contact us for more details. 


11.1 If the goods contain any safety device(s) and/or are to be fitted in accordance with child safety requirements placing an obligation on all businesses to supply and professionally install safe products, then we will be obliged to install such device(s). In the event that you should instruct Us that You do not wish to have the safety device(s) fitted, we will refuse to install the Goods. In such instance, you will still be liable to pay up to the full price. 

The contract is between You and Us. No other person shall have any rights to enforce any of its terms.

The Goods supplied/installed by us will become your property once we have received payment for them in full. The Goods become your responsibility from the time; they were delivered to the address you gave Us; you collected the Goods from Us; or the time we passed the goods to any third party, organised by you.

This contract is subject to Scottish Law and the exclusive jurisdiction of the Scottish Courts.

Firstly, expectations by You can only be met by World of Blinds & Interiors Ltd when they are communicated to us before you place an order. Expectations on ‘Room Darkening’ may not be achieved due to many factors, the product chosen, external streetlights, large windows, windows facing certain directions that get more sun at certain times of the day, if there are large mirrors or mirrored wardrobes in the room that will reflect and emphasize any light bleed. Speak with our advisors and heed any advice when expressing your needs and desires for your chosen products. Our surveys are verbally communicated and we can only advise appropriately when we know what Your expectations are. If a product does not meet your desired requirements without them being communicated to us, we can rectify as much as possible, but only when the full balance has been paid and a reasonable cost for remedial work has been agreed upon and confirmed. This is due to all our products being bespoke, handmade and made to measure.


ROLLER BLINDS


Although ‘Blackout’ blinds may be requested, please carefully note that whilst the fabric You have chosen may be called ‘blackout’, or ‘blockout’, the product is not. We offer Cassette Blockout Blinds that give far greater room dimming properties, but come at a higher cost and may not be suitable for all windows. Expectations for room darkness can only be met, when they are communicated to us BEFORE any order has been placed.


All our roller blinds are manufactured from Louvolite componentry unless otherwise requested or should we need to outsource manufacturing to an external supplier for any reason.


We will manufacture the roller blinds with appropriate size headrails, according to the width, drop and weight of the material to reduce any deflection. Any oversized blinds may still have it, depending on the size and materials chosen. Expectations need communicated before any order has been placed. Any requests will be given consideration but anything we manufacture out with our advice will be void of any guarantee.


Perfect Fit Roller Blinds are not Blackout products. You get quite a lot of light bleed due to the nature of its construction, and due to the product being fitted directly onto the glazing bead with no window frames to reduce the light.


In 2018, we changed our production on Perfect Fit Rollers to manual chain operation as standard, from the older, tensioned, spring operated Perfect Fit Roller System. We can still make the tensioned system on request. Chains will be attached to the frame and will be 300mm long, unless requested to be longer.


Perfect Fit Rollers are designed so they can be installed to tilt and turn windows. The casing that houses the material at the top if the window, only comes in one size. Any Perfect Fit Roller Blind that has a drop over 1.3 metres, may not fully retract for this reason and thickness of the material may also be contributing factor for this.


VERTICAL BLINDS


Although Blockout materials me be chosen, a vertical blind is not a blackout product, due to the nature of its construction. Some Blockout fabrics are white on the back. They may be lined or have White Pvc. This is usually to keep the continuity the same from the outside if you have matching Roller Blinds. Please be aware that the samples in our books are exactly how the slats will come and may be a different colour on one side.


Child Safety devices need to be shortened so they are 1500mm from the floor, and attached securely with a safety guard, into either the side recess or face fixed on to the frame. This is to comply with Child Safety Requirements (BS EN 13120) and is an express condition of sale. Please keep this in mind if you are having Vertical Blinds installed where you may have to stretch, over a kitchen worktop for example. Should you not wish child safety devices attached for some reason, we would be unable to install your Blinds. Please see Part 11 of our Terms and Conditions for clarification (Child and Vulnerable Persons Safety).


We offer 3 types of bottom weights, Weights and Chains, Chainless Weights and Welded Weights. Weights and Chains, Chainless Weights come at no extra cost, but Welded Weights cost extra. Your choice will be on your quotation or order confirmation, please let us know ASAP if you wish to change your choice, after your quotation or confirmed order, as it will be too late to change them once the slats have been manufactured. Any changes after that point will be chargeable.


VENETIAN BLINDS


Venetian Blinds are privacy and light controlling blinds and not room darkening due to the nature of its construction. Perfect Fit Venetians are the same, but due to the gap from the top slat and headrail being directly against the glass, light bleed it is emphasized on this product.


Tensioned Perfect Fit Venetians may sit slightly squint to the windows if they are made very narrow. This is due to the lack of weight of the blind.


WOODEN VENETIANS


Wooden Venetians are privacy and light controlling blinds and are not designed with room darkening in mind, due to the nature of its construction.


Wooden Venetians are a natural product, for this reason, variations in shade, graining, mineral deposits as well as warping and discoloration may occur. These are also not suitable for damp or moisture environments as wood will absorb moisture and warping may occur. We only recommend the cleaning of wooden products with dry clothes or dusters. We do not recommend putting natural grained woods side by side or even in the same room, as depending on which part of a certain tree they come from, they could look different when side by side. Perfect Grain woods are recommended or Fauxwood in these situations.


Wooden Venetians have limitations on sizes due to the weight of the product as well as being made from natural materials.


FAUXWOOD VENETIANS


Fauxwood Venetians can be made slightly bigger than Wooden Venetians due to them being an engineered material. They are made from PVC, which is substantially heavier than real wood. For this reason, please consider whether this product is suitable for you, especially on larger windows.


This product is far more suitable for moisture conditions like Bathrooms, Ensuites and Kitchens or in rooms where colour matches are required.


VISION/DAY AND NIGHT BLINDS


Vision/Day and Night Blinds, due to the nature of their construction are not a room darkening product. They are designed for privacy, security and for controlling light. Although some materials are classed as ‘Blackout’, the product is not designed to darken rooms, just to be more substantial in reducing the glare from the sun.


Vision/Day and Night Blinds are designed to be motorised. They can be made with manual chain operation and the blinds will work but gaining access to the controls may be quite difficult due to the fabric running in front of the controls, from the cassette headrail. Keep this in mind when ordering manually operated Vision/Day and Night Blinds.


Although certain fabrics may be made up to 2.6 metres wide, from our experience, anything wider than 2.2 metres can have a wave in the material due to the flex of the bottom bar. We may make them bigger, but it is against our recommendations, therefore no guarantee will be provided for any Visions/Day and Night Blinds made wider than 2.2 metres.


Perfect Fit Vision/Day and Night Blinds are also not a ‘blackout’ product due to the nature of their construction, as well as them being fitted directly against the glazing and having no window frame to reduce and light. They are designed so they can be installed to tilt and turn windows. The casing that houses the material at the top if the window, only comes in one size. VISAGE BLINDS


Visage Blinds, due to the nature of their construction are not a room darkening product. They are designed for privacy, security and controlling light.


Although certain fabrics may be made up to 2.6 metres wide, from our experience, anything wider than 2.2 metres can have a wave in the material due to the nature of its construction and strength of the material. We may make them bigger, but it is against our recommendations, therefore no guarantee will be provided for any Visage Blinds made wider than 2.2 metres.


PLEATED AND CELLULAR BLINDS


Pleated and Cellular Duette Blinds have limitations on size. We manufacture them to the drop of the window. Sagging or stretching of the pleats may occur on larger pleated blinds but we will make them to the manufacturers recommended specifications to try and reduce these issues as much as possible.


Perfect Fit Blackout Cellular Blinds are the darkest of the Perfect Fit Products, although they are still not a blackout product due to them being fitted directly to the glass. There is still light bleed with this product.


When operated as top-down bottom-up, or ‘multizone’, due to the nature of its construction, they may need adjusted manually when operated, for them to sit straight to the window. Having them Top Down or Bottom Up reduces the need to manually straighten them but doesn’t eliminate the need completely.


ALLUSION BLINDS


Allusion Blinds come as a double wanded tilt control as standard. Due to the nature of its construction, they cannot be split in the middle like a vertical blind. This would create a substantial visual gap.


They are not a Blackout product. They offer room dimming and privacy properties with the idea of enabling views when tilted open.


ROMANS


Roman Blinds will sit above the windowsill. If you request them to sit on the sill, they may pucker when closed. The fabric will stretch slightly after they have been hanging for any length of time.


We always recommend adding blackout lining to our Roman Blinds, although the product is not completely blackout. The advice is so there is no dilution or variation in the colour of the fabric, and so the sewing/stitching and folding of the materials are less visible. When mounted above a window, as recommended, they hang out from the wall, allowing light to come through the sides, top and bottom. You may request the drop to be made to come past the windowsill, but you may need to manually pull it past the sill when lowering/raising.


When installed within a recess, the fabric will be measured to sit above the windowsill, so they don’t pucker when closed. The manual chain operation will then sit behind the material, making it difficult to operate. Therefore, we advise them to be installed outside the window recess where possible. 


Roman Blinds, when open, may have a large gather. This may be due to the amount of material required for the drop, the pattern repeat or simply the weight of the material. Any expectations on the gather will need addressed before any order has been placed. If you have not expressed your expectations to us, alterations can be done afterwards, but any cost involved will be at Your expense.


For patterned materials, pattern matching is difficult due to the fabric being soft, needing lined as well as being completely manufactured by hand. Where matching is required, our suppliers strive to match them as best they can, but they may not be able to do it perfectly for these reasons. On larger windows, where fabrics will need joined, we recommend plain, textured, checked or tartan materials for a more seamless join.


We do not recommend making Roman Blinds over 2.3 metres wide, due to the weight of the blind and the number of joins required. Any Roman Blind that is made bigger than what is advised, comes with no guarantee for this reason.


CURTAINS, AND VOILES


All our Curtains and Tracks are made to measure, and any expectations will need to be addressed before an order has been placed. Whether it be sizes, where they are to be mounted, or where you would like them to sit once installed.


Curtains are not a ‘blackout’ product due to the nature of their construction and how they are installed.


SHUTTERS


All Wooden Shutters are manufactured in China and lead times may vary. This may be due to the Chinese New Year being within your order (February), material shortages or supply and shipping issues. These things are out-with our control and can quite often be unforeseeable and un-preventable. 


Due to them being made from natural materials, colour variations my differ slightly from samples and on grained materials, variations in shade, graining, mineral deposits as well as warping and discoloration may occur.


Damages may also occur during shipping and transporting. All remedials will be rectified as soon as possible, but as they are manufactured overseas, the times for them to be rectified will be under the same lead time conditions as the original order. The World of Blinds & Interiors Ltd has no control over this.


We do not recommend putting Wooden Shutters into Bathrooms, Ensuites, Kitchens, or any other rooms where there will be a lot of moisture. Any orders where this is asked for come with no guarantee, as it against our recommendations and warping may occur. PVC Shutters with Stainless Steel hardware would be advised for these environments.


Although some of our PVC Shutters are manufactured in the Uk, lead times may also be variable and out-with any control of ours.

The World of Blinds & Interiors Ltd cannot be held responsible for any delays with Shutters, but we can promise to prioritise any installation of them when they arrive, to the best of our availability.


AWNINGS AND CANOPIES


Our Awnings are a made to measure product, made to suite your needs and requirements and within the limits of the product. Dependent on the surface that the product is to be mounted to, will determine the type of brackets and fixings used. 


Weather conditions. Awnings are designed to protect against the sun and light rain only. Commonsense must prevail when using an awning in inclement weather conditions. Especially as we live in the North of Scotland. Awnings should not be left extended in heavy rain and/or during snow fall, as the excess weight is likely to damage the arms of the awning. Should you request a valance to the front of the awning you will be shown at the time of install how to remove the valance for UV protection during the winter months when the awning is likely not to be in use.


Motorisation. We recommend all awnings to be fully motorised. This includes the addition of a wind sensor (the wind Sensor monitors wind conditions and will retract the awning when gusts exceed the settings). Again common sense must be used when using awnings in inclement weather conditions and should a wind sensor not be added to the order, The World of Blinds & Interiors Ltd cannot be held responsible for any damages to the product or the property, as a result of it not being retracted when the weather is adverse.

Manual awnings are operated using a crank handle, no other method should be used. 


As Awnings are a product that we do not manufacture ourselves, lead times may be out with our control. They may take longer at certain times of the year or when the demand for them is higher.


SPECIALIST PRODUCTS (SHAPED BLINDS)


Specialist Products are often prototypes or untested. They are handmade, bespoke and made to measure. They are risky and usually expensive. We take full payment for these up-front due to these reasons and any expectations on operation, room darkening properties or visual aesthetics of these products are often unknown until the product has been manufactured and installed. Any expectations by you need to be made clear to us before any order for these has been placed, as after they have been installed is too late to addressed.


Please note that any images of any products we supply, in our sales literature or online, are for illustration purposes only, and we cannot guarantee that these printed/computer displayed images will reflect the colour of the goods accurately. Our packaging may also vary.

Please make sure you know exactly what you are getting before committing to any order of this nature.


Lead times can be longer on these products due to the nature of the manufacturing and delivery of these Goods.
